Terms of Use

These Terms of Use ("Terms") govern access to and use of the Decalker platform. By creating an account or using any feature, you agree in full to this document. If you do not agree, do not use the product.

1. Definitions

• "Platform": the decalker.com website and all associated tools (5 features: Decalkar, Create with AI, Mix, Try on skin, Refine).
• "User": a natural person who creates an account and uses Decalker.
• "Decalker" or "we": Raphael Marques Salles, based in Sao Paulo, Brazil.
• "Content": images, text, prompts, and other materials that the User uploads or generates on the platform.

2. Who may use it

• Natural persons over 18 years of age.
• Professionals in tattooing or related fields.
• You agree to provide truthful information (name, email).

3. Account and security

• Sign-in by email (with an access link for existing accounts), an optional password, or Apple/Google. Passwords, when set, are stored only as bcrypt hashes.
• Your session remains active for 30 days through an httpOnly cookie. You may sign out (log out) at any time.
• You are responsible for the security of your registered email. If someone accesses your email, they may access your account. We recommend enabling 2FA on your email account.
• One account per person. Multiple accounts used to circumvent the free quota may be blocked without notice.

4. Quota and Plans

Each plan includes a monthly amount of tokens. A standard generation (Decalkar, Mix, Try on skin, Refine) uses 50 tokens. Create with AI and the premium Mix engine use 100 tokens. Tokens renew on the first day of each month (UTC) and do not roll over from one month to the next.

4.1 Free (R$0/month)

• 500 tokens/month across all 5 features.
• Export with a watermark.
• No card required. You may use it indefinitely within the limit.

4.2 Pro (R$49.90/month)

• 5,000 tokens/month.
• Without a watermark. PNG, SVG, and 1:1 PDF export in HD quality.

4.3 Studio (R$99.90/month)

• 10,000 tokens/month.
• Everything in Pro, with twice the monthly token limit.

Paid plans renew automatically each month through Stripe (international card) or Mercado Pago (PIX, Boleto, or Brazilian Card), according to the User's choice. In the iOS app, the subscription is purchased and renewed by Apple through In-App Purchase, and it is managed and canceled in your App Store subscription settings. Cancel at any time, with no fee.

5. Acceptable use

You agree not to:

• Submit unlawful, offensive, discriminatory, or pornographic content involving minors, or content that violates third-party rights.
• Upload third-party copyrighted images without authorization to use them as a reference. You confirm that you have the right or license for all images you submit.
• Use Decalker to create tattoos containing hate symbols, content involving the sexual exploitation of minors, or material that violates laws.
• Attempt to break into, reverse engineer, or misuse the system (rate limit bypass, multiple accounts to obtain the free quota, scraping, etc.).
• Resell access, share credentials, or use the API without authorization.

Violations may result in immediate suspension of the account, without a refund, in addition to civil and criminal liability where applicable.

6. Intellectual property

6.1 Your content

• You retain 100% of the copyright in the original images you upload.
• AI-generated stencils and designs based on your content are licensed to you for commercial use in tattoos, your portfolio, and personal marketing, with no royalty.
• You grant us a limited license to process your images for the time necessary to generate a result and store it in your library.

6.2 Generative AI: limitations

AI models may generate results similar to images that already exist in the world. Decalker does not guarantee the artistic exclusivity of the output. Before tattooing, you are responsible for checking whether the final design infringes a third party's copyright.

6.3 Decalker brand

The name "Decalker", logo, domain, and visual style are our property. Do not use them without written authorization.

6.4 Anonymous use in marketing (opt-out)

We may use anonymous samples of generated stencils in marketing materials (without identifying you or your client). To opt out, emailhi@decalker.com.

7. Payment and refunds

• Payments are processed by Stripe (international card) or Mercado Pago (PIX, Boleto, Brazilian Card). In the iOS app, by Apple through In-App Purchase. Decalker does not store card data.
• Monthly automatic renewal. You may cancel at any time in/dashboard/billing, or, on iOS, in your App Store subscription settings. Cancellation takes effect at the end of the paid period.
• Right of withdrawal (CDC Art. 49): a digital contract may be canceled with a full refund within 7 days of the first charge, by emailing hi@decalker.com. Purchases made through In-App Purchase are refunded by Apple, under Apple's own policy.
• After 7 days, there is no retroactive refund for a month that has already started. Cancel and the plan will not renew.
• Taxes (ISS, IRPF withheld at source for corporate payers) are governed by applicable legislation.

8. Service availability and changes

• Decalker is offered "as is" (as is) and "as available" (as available), with no guarantee of 100% uptime or freedom from bugs.
• We reserve the right to modify features, discontinue plans (with 30 days' notice), or change underlying technologies (AI models, etc.).
• If there is a material change that is adverse to a paid User, we offer a proportional refund for the unused period.

9. Limitation of liability

Decalker is a creative support tool. The final result tattooed on skin depends entirely on the tattoo artist User (design choice, technical execution, client consent, safety, hygiene). We are not liable for:

• The quality or aesthetics of the final tattooed design.
• Allergic reactions, infections, or complications arising from the tattooing procedure.
• Disputes between the tattoo artist and client about design or expectations.
• Copyright violations committed by the User when using third-party images without authorization.
• Temporary unavailability of AI providers (Vercel AI Gateway, Replicate, etc.).

Our total liability, where applicable, is limited to the amount paid by the User in the preceding 12 months.

10. Suspension and termination

• You may terminate your account at any time in /dashboard/settings or by email.
• After termination, we delete your personal data within 30 days, except for information that must be retained due to a legal obligation (payment, tax).
• We may suspend or terminate your account in the event of a violation of these Terms, fraud, or a risk to our infrastructure.

11. Changes to the Terms

We may update this document. Material changes (that affect rights or obligations) will be notified by email 15 days in advance. Continued use of Decalker after that period means acceptance of the new rules.

12. Applicable law and venue

These Terms are governed by the laws of the Federative Republic of Brazil (Civil Code, CDC, Marco Civil da Internet, LGPD).

The courts of the District of Sao Paulo/SP are hereby selected to resolve any disputes, with express waiver of any other jurisdiction, however privileged it may be.

13. Final provisions

• The invalidity of one clause does not affect the others.
• Our failure to exercise a right does not constitute a waiver.
• You may not assign these Terms to third parties without our written authorization.
• These Terms together with the Privacy Policyform the entire agreement between you and Decalker.
